The Natural Resources, Transportation and Indigenous Legal Group, Transportation and Land Unit, is recruiting one regular, full-time real property solicitor - specifically, a Legal Counsel 1 (up to five years of call),a Legal Counsel 2 (six to 11 years of call) or a Legal Counsel 3 (12 years of call or more) to provide legal advice and services to the Ministry of Transportation and Infrastructure (MOTI), and the BC Transportation Financing Authority (BCTFA).

This position will support MOTI's ongoing mandate, with a focus on highway, transportation, and public infrastructure projects. These projects typically involve high-profile government commitments and private-sector involvement (planning and financing) on accelerated timelines.

This position will also provide legal advice and services to MOTI on land matters, including:
  • developing and considering options for structuring, negotiating and drafting agreements for land transactions including acquisitions, expropriations (section 3 agreements), dispositions and land development, as well as in negotiating and drafting project agreements, s. 219 covenants, statutory rights of way, leases and licenses;
  • registering plans establishing highways, as well as other types of land title plans;
  • dealing with and advising on all manner of MOTI land-related issues;
  • preparing and providing ongoing legal support for the use of standard MOTI legal documents; and
  • reviewing historical land title and other legal documents to determine the legal status of highways.

The ideal candidate must be able to quickly identify, analyze and propose solutions to legal issues and provide practical advice on legal and transactional issues that arise in relation to advising MOTI, and the BCTFA. They must also have the ability to creatively and diplomatically manage multiple files with competing priorities, pressing deadlines and multiple stakeholders. Travel may be required.

The Attorney General is the legal advisor to the government of British Columbia and is charged with ensuring that the administration of public affairs is carried out in accordance with the law. The Ministry of Attorney General is structured to carry out this mandate under the direction of the Attorney General, and Legal Services Branch supports the Ministry in fulfilling this mandate by serving as legal advisor to government in civil law matters. Legal Services Branch provides legal advice to government and ensures that legal risks associated with government operations are reduced. Legal Services Branch's clients include all Ministries of the government, Cabinet and certain public agencies.

Job Requirements:
  • Eligibility for Membership in the Law Society of British Columbia.
  • Level dependent on years of call (up to five years of call for a Legal Counsel 1, six to 11 years of call for Legal Counsel 2, and 12 years of call or more for a Legal Counsel 3).
  • Experience with government policy and operations is an asset.
  • Very strong academic records, clerkships and relevant publications are assets.

Preference may be given to:
  • Applicants with current experience with real property law, conveyancing and commercial transactions, including structuring and negotiation of and drafting agreements for land development projects.
  • Applicants with current experience with land title practice requirements, especially in relation to the acquisition and disposition of lands for highway purposes and approvals of subdivision plans by approving officers.
  • Applicants with current experience with local government law and environmental law.
  • Applicants with current experience with relevant legislation, including theLand Title Act, theLand Act, theExpropriation Act, and theTransportation Act.
